Terms of Service

By using Listpens, you agree to these terms. Please read them carefully — particularly the sections on Fair Housing compliance and AI-generated content.
1. Acceptance of Terms
By accessing or using Listpens ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Listpens is an AI-powered copywriting tool designed to assist real estate professionals with generating listing descriptions, agent bios, social captions, email templates, driving directions, and related content. The Service uses Claude AI (Anthropic) to generate content based on user-provided inputs.
3. Fair Housing Act Compliance
⚠️ Important: Listpens provides a Fair Housing language screening tool as a convenience feature only. This tool is NOT a guarantee of compliance with the Fair Housing Act, NTREIS MLS rules, NAR guidelines, or any other applicable law or regulation.
The Fair Housing Act (42 U.S.C. § 3604) prohibits discrimination in the sale or rental of housing based on race, color, religion, sex, handicap, familial status, or national origin. This prohibition applies to all real estate advertising, including MLS listings, social media posts, email communications, and any other content generated using this Service.
You are solely responsible for:
- Reviewing all AI-generated content before publishing, submitting, or distributing it
- Ensuring all content complies with the Fair Housing Act and applicable state and local fair housing laws
- Ensuring all content complies with NTREIS MLS rules and regulations, including but not limited to rules regarding public remarks content
- Ensuring all content complies with NAR Code of Ethics and your brokerage's policies
- Removing, modifying, or replacing any flagged language identified by our Fair Housing screening tool
Our Fair Housing screening tool uses pattern matching and context-aware analysis based on HUD's published guidelines. It is designed to assist — not replace — your professional judgment. No automated tool can guarantee complete Fair Housing compliance in all contexts. Words and phrases must always be evaluated in context.
Listpens, its founders, employees, and affiliates accept no liability for Fair Housing violations, MLS compliance violations, or any other legal consequences arising from content generated by the Service.
4. NTREIS MLS Compliance
If you are submitting content to NTREIS or any other MLS, you are responsible for ensuring that content complies with all applicable MLS rules, including:
- No contact information (names, phone numbers, email addresses, websites) in public remarks fields
- No offers of buyer agent compensation in any field
- Character limits for public remarks fields (typically 2,000 characters for NTREIS)
- All other applicable NTREIS rules and regulations
Listpens is not affiliated with NTREIS, MetroTex, or any MLS provider. Use of this Service does not constitute MLS compliance approval.
5. AI-Generated Content
All content generated by Listpens is produced by AI and may contain errors, inaccuracies, or inappropriate language despite our best efforts. You acknowledge that:
- AI-generated content must always be reviewed and edited before use
- You are responsible for the accuracy of all information you submit to generate content
- Listpens does not guarantee the accuracy, completeness, or appropriateness of any generated content
- Generated content is a starting point, not a final product
6. Payment Terms
Paid plans are billed monthly. Subscriptions renew automatically unless cancelled. Pay as you go credits are non-refundable. Partial months are not refunded upon cancellation. All payments are processed by Stripe.
7. Free Trial
One free draft is available per email address. Free trial abuse (including use of multiple email addresses to circumvent the limit) is prohibited and may result in account termination.
8. Prohibited Use
You may not use the Service to generate content that:
- Violates the Fair Housing Act or any applicable fair housing law
- Is fraudulent, misleading, or materially inaccurate
- Violates any MLS rules or real estate regulations
- Infringes on any intellectual property rights
- Is used for spam, bulk email, or unsolicited communications
9. Intellectual Property
The Listpens platform, brand, code, prompts, and design are owned by Listpens and protected by copyright law. Content you generate using the Service belongs to you, subject to these Terms.
10. Limitation of Liability
To the maximum extent permitted by law, Listpens shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to Fair Housing violations, MLS compliance violations, or losses resulting from AI-generated content.
11. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. Listpens does not warrant that the Service will be error-free, that generated content will be compliant with any law or regulation, or that the Fair Housing screening tool will identify all potentially problematic language.
12. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Collin County, Texas.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
